Agreement to Terms

By accessing or using TrustedGoods (the "Service"), available at trustedgoods.co, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you and TrustedGoods ("we," "us," or "our"). Please read them carefully.

Eligibility

You must be at least 13 years old to use TrustedGoods. If you are between 13 and 18 years old, you may only use the Service with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.

By using the Service, you represent and warrant that you meet these eligibility requirements.

Account Registration

Creating an Account

To access certain features of the Service, you must create an account. When registering, you agree to:

  • Maintain and promptly update your account information
  • Choose a unique username that does not impersonate another person or entity
  • Not create more than one account per person

Account Security

The Service

Description

TrustedGoods is a community platform for authentic product reviews. The Service allows users to write and read product reviews, rate products, comment on reviews, and interact with other community members.

Availability

We strive to keep the Service available at all times, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss or inconvenience caused by Service interruptions.

User Content

Your Content

You retain ownership of the content you post on TrustedGoods, including reviews, ratings, comments, and photos ("User Content"). By posting User Content, you grant us a worldwide, non-exclusive, royalty-free, transferable license to use, display, reproduce, distribute, and create derivative works of your User Content in connection with the operation and promotion of the Service.

This license continues even if you stop using the Service, but only for content that has already been shared publicly. If you delete your account, we will remove or anonymize your content in accordance with our Privacy Policy.

Content Standards

All User Content must comply with our Community Code of Conduct. In addition, User Content must not:

  • Be false, misleading, or deceptive
  • Be a sponsored, paid, or incentivized review (reviews must reflect genuine, independent opinions)
  • Infringe on any third party's intellectual property rights
  • Contain malicious code, viruses, or harmful content
  • Violate any applicable law or regulation

Content Moderation

We reserve the right, but are not obligated, to review, edit, or remove any User Content that violates these Terms or our Code of Conduct. We may also suspend or terminate accounts that repeatedly violate our content standards.

DMCA / Copyright Policy

We respect the intellectual property rights of others. If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please send a notice to our designated DMCA agent at support@trustedgoods.co containing:

  • A description of the copyrighted work you claim has been infringed
  • A description of where the allegedly infringing material is located on the Service
  • Your contact information (name, address, phone, email)
  • A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law
  • A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner
  • Your physical or electronic signature

Prohibited Conduct

When using the Service, you agree not to:

  • Violate any applicable law, regulation, or these Terms
  • Use the Service for any illegal, fraudulent, or unauthorized purpose
  • Interfere with or disrupt the Service or its infrastructure
  • Attempt to gain unauthorized access to other users' accounts or our systems

  • Collect or harvest other users' personal information without their consent
  • Impersonate another person, entity, or TrustedGoods staff
  • Circumvent or manipulate our content moderation or enforcement systems
  • Upload or transmit malware, viruses, or other harmful code

Intellectual Property

Our Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are owned by TrustedGoods and are protected by copyright, trademark, and other intellectual property laws. Our trademarks, logos, and service marks may not be used without our prior written consent.

Feedback

If you provide us with any feedback, suggestions, or ideas about the Service ("Feedback"), you grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free license to use, modify, and incorporate that Feedback into the Service without any obligation to you.

Third-Party Services

The Service may integrate with or contain links to third-party services, including AWS Cognito for authentication. We are not responsible for the content, policies, or practices of any third-party services. Your use of third-party services is governed by their respective terms and privacy policies.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

User Content Disclaimer

WE DO NOT ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR ANY USER CONTENT POSTED ON THE SERVICE. USER REVIEWS AND OPINIONS ARE THOSE OF THE INDIVIDUAL USERS AND DO NOT REPRESENT THE VIEWS OF TRUSTEDGOODS. WE ARE NOT RESPONSIBLE FOR ANY PURCHASING DECISIONS MADE BASED ON USER CONTENT.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRUSTEDGOODS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (C) ANY CONTENT OBTAINED FROM THE SERVICE; OR (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

IN NO EVENT SHALL OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE EXCEED ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.

Indemnification

You agree to indemnify, defend, and hold harmless TrustedGoods and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to:

  • Your use of the Service
  • Your User Content
  • Your violation of these Terms
  • Your violation of any rights of another person or entity

Dispute Resolution

Informal Resolution

Before filing any formal dispute, you agree to first attempt to resolve the dispute informally by contacting us at support@trustedgoods.co. We will attempt to resolve the dispute within 30 days.

Binding Arbitration

If a dispute cannot be resolved informally, you and TrustedGoods agree that any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in the United States, and the arbitrator's decision shall be final and binding.

Class Action Waiver

YOU AND TRUSTEDGOODS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A REPRESENTATIVE OR CLASS PROCEEDING.

Exceptions

Nothing in this section shall prevent either party from seeking injunctive or other equitable relief in court for matters related to intellectual property, data security, or unauthorized access to the Service.

Opt-Out

You may opt out of the arbitration agreement by sending written notice to support@trustedgoods.co within 30 days of first accepting these Terms. Your notice must include your name, address, and a clear statement that you wish to opt out of the arbitration provision.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

If you do not agree to the updated Terms, you must stop using the Service and may delete your account.

Termination

By You

You may terminate your account at any time by deleting your account through the Service settings or by contacting us at support@trustedgoods.co.

By Us

We may suspend or terminate your account and access to the Service at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to, violation of these Terms, violation of our Code of Conduct, or conduct that we determine is harmful to the community or the Service.

Effect of Termination

Upon termination, your right to use the Service will immediately cease. The following sections survive termination: User Content (license grant), Disclaimers, Limitation of Liability, Indemnification, Dispute Resolution, and General Provisions.

General Provisions

Entire Agreement

These Terms, together with our Privacy Policy and Community Code of Conduct, constitute the entire agreement between you and TrustedGoods regarding the Service.

Severability

If any provision of these Terms is held to be unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
